I wouldn't have answered that correctly, but after looking it up, it's less a grammatical error so much as a grammatical construction.

Unfortunately, those of us as members of The Elders do not recognize the difference between a grammatical construction and a grammatical error. If it's wrong, we go to war with your country.

i believe the "rule" is adopted from latin where infinitives are single words (not to with a base verb) and thus unable to be "split"
