I think the issue isn't so much the 2 stepping, but the fact that he was asking if you were at war. If so, there shouldn't be any reason for you to be landgrabbing. You should be hitting the alliance you are warring.

If you are at war, and hitting untaggeds, it's obvious that the war you are in is over, and you can be removed from a DNH status.
